General Conditions of Use.
1 - Preamble
The purpose of these General Terms and Conditions of Use, hereinafter referred to as the "GCU", is to determine the conditions of access to the Website and the terms and conditions of use of the Services by Users. By using the Site, you accept in their entirety the T&Cs, which BATEAUX.INFO reserves the right to modify at any time and without notice.
2 - Legal information
The Site is published by BATEAUX INFO, a SAS with a capital of 200,000 euros. Company registered in the Evry Trade and Companies Register under number 812623643 whose registered office is located at 6 ter, rue Van Loo - 91150 Etampes - France.

3 - Warning to users
The User declares that he accepts the characteristics and limits of the Internet and, in particular, acknowledges:
- be aware of the nature of the Internet network and in particular its technical performance and response times, in order to consult, query or transfer information data;
- that data circulating on the Internet are not necessarily protected, in particular against possible misappropriation;
- that the communication, by the User to third parties of his identifiers, passwords, and generally speaking, of any information deemed by the User to be personal or confidential is at his own risk;
- that it is the User's responsibility to take all appropriate measures to protect his own data and/or software from contamination by possible viruses on the Internet network.
The User is solely responsible for the choice, use and interpretation of the data he consults, questions and transfers on the Internet and for the use of the services offered by the Site, for which he cannot be held liable in any way whatsoever.
The information provided by BATEAUX.INFO on the Site is for information purposes only. BATEAUX.INFO cannot guarantee the accuracy, adequacy, completeness or timeliness of the information published on its Site. Consequently, the User acknowledges that he/she uses this information under his/her exclusive responsibility without BATEAUX.INFO being held liable. BATEAUX.INFO is released from any responsibility following the use of the Site and the Services.
4 - Registration, creation of a user account
In order to access the Site, the User must register by creating a User account directly on the Site.
The User must be at least 18 years old and complete all mandatory fields on the registration forms. The User guarantees that the data he communicates are accurate and in accordance with reality.
During the registration process, the User must accept the T&Cs by validating the relevant box, which constitutes full acceptance. The User must accept the policy on the protection of personal data, which implies full and complete acceptance. If the acceptance boxes are not validated, the registration is refused. The public space remains accessible.
5 - Suspension of access to services
BATEAUX.INFO may suspend, at its sole discretion, without notice and at any time, access to the Services of the Site and/or provide new login credentials to the User. Access to the Site and Services may be suspended temporarily or permanently by operation of law and without delay if, for example, the User does not comply with these T&Cs, in particular in the event of the distribution via the Site of content that is contrary to law, regulations, public policy or offensive and/or unethical content of BATEAUX.INFO (content of any kind, including violent, pornographic, racist, xenophobic, antisemitic, controversial, defamatory, offensive or denigrant content). The responsibility of the BATEAUX.INFO cannot under any circumstances be engaged following a temporary or permanent suspension of access to the Site and Services.
6 - Publication & intellectual property
The User has the possibility to publish on the Site Content such as text, data, photographs, images, videos, sounds, links, and any other elements likely to be shared. BATEAUX.INFO has no legal obligation to control the content published by Users or the veracity of the content they publish under their full and entire responsibility.
The User grants BATEAUX.INFO on a non-exclusive, non-exclusive, free of charge basis, for the entire world and for the term of protection indicated in the Intellectual Property Code, all intellectual property rights relating to the Content for reproduction, representation, display, distribution, distribution and communication, the adaptation, editing, modification, translation, incorporation into other works, creation of derivative works, hosting, storage, for the use and exploitation, improvement, promotion and development of the Site and its Services, by any means, processes, media, including digital. In this respect, the User agrees in particular that all the Content he publishes on the Site may be made available to the public. With the exception of Content deposited by Users, in the condition they have submitted themselves, the content on the Site, such as logos, texts, information, sounds, graphics or images, is the property of BATEAUX.INFO and, where applicable, its partners. The user is allowed to consult them only for personal use. Any commercial exploitation at a local, national or international level is prohibited. Consequently, the User undertakes in particular not to reproduce, modify, publish, issue, post, transmit or distribute, by any means whatsoever, without the prior written authorisation of BATEAUX.INFO, the content, information, data and elements present on the Site, such as logos, texts, sounds, graphics, photographs or images.
It is also recalled that all trademarks, logos, trade names or other intellectual and industrial property elements present on the Site are registered by BATEAUX.INFO and its partners.
Any use not expressly authorized herein results in a violation of the intellectual property rights of BATEAUX.INFO or its partners and constitutes an infringement. It may also result in a violation of image rights, personal rights or any other rights and regulations in force. The User is therefore informed that any operation not expressly authorized may result in civil or criminal liability. BATEAUX.INFO reserves the right to take legal action against any User who has not respected this prohibition.
7 - Referencing
All elements published on the Site, including comments and photographs published on the Site by the User may be referenced on a search engine and are therefore likely to be visible to an audience outside the Site.

9 - Cookies

10 - Protection against piracy
Technical means in accordance with the rules of the art are put in place to secure the Site, including the stored data.
However, the User's attention is drawn to the fact that this security may be compromised by third parties, or even by the User himself with the applications or software he uses with his computer or mobile equipment. The User is informed that it is strongly discouraged to use publicly accessible computers to access the Site, as their security may be compromised, particularly with computer programs that capture personal login credentials. The User must take all appropriate measures to protect his equipment against any intrusion or contamination by any malicious code, such as viruses, circulating on the Internet network.
11 - Lawful use
It is prohibited to use the Services of the Site as well as any data related to them for fraudulent, illegal or, in general, contrary to a provision punished by civil or criminal law.
It is prohibited to divert the Services from their purpose, in particular by downloading illegal data or data that would infringe the rights of third parties or by carrying out illegal activities. BATEAUX.INFO may decide, at its sole discretion, without notice, and at any time, to delete any content, illegal or not, infringing the rights of third parties, as soon as it becomes aware of it. The User accepts that the comments, photographs, images, descriptions, advertisements, messages that he/she submits to the Site may be moderated or deleted by BATEAUX.INFO, without prior warning.
Any fraudulent access by the User to the Services of the Site is prohibited and punished by the Criminal Code, as is the maintenance, alteration and obstruction of the functioning of the Site and/or the Services, as well as the fraudulent introduction, deletion or modification of data on the website and/or the Internet platform.
The User is solely responsible for the use made of the Services of the Site and must take all necessary precautions to ensure that unauthorized third parties cannot access his data, in particular in the event of theft, non-supervision or loss of the terminal on which the Website is installed.
The User agrees in particular not to:
- impersonate another person or speak on behalf of a company, association, etc. without authorization,
- be aggressive or violent,
- disseminate deliberately false information,
- disclose confidential information,
- deposit elements containing viruses,
- harass another User or a third party in any way, including by repeating the same or similar messages,
- make statements inciting hatred, violence, suicide, terrorism, the practice of illegal activities or the commission of crimes or offences,
- make statements of a discriminatory, racist, xenophobic, anti-Semitic, homophobic, negationist, pornographic, paedophile nature, etc,
- advertise a brand, product or service other than BATEAUX.INFO or its partners
- collect and store the personal data of other Users,
- manipulate the pseudonym in such a way as to conceal the origin of the message posted on the Sites,
- behave in such a way as to damage the image and/or reputation of BATEAUX.INFO.
- to extract automatically and by any means, the information appearing on the Site is prohibited. The use of robots, programs allowing direct data extraction is strictly prohibited.
The User undertakes not to promote, in his comments, websites that contravene these General Terms and Conditions of Use, and in particular not to include in his comments hypertext links to websites that contravene these General Terms and Conditions.
12 - Liability
BATEAUX.INFO cannot under any circumstances be held liable for any direct or indirect damage resulting from the consultation or use of the Services on the Site.
BATEAUX.INFO cannot under any circumstances be held liable for any damage that may result from content published by a User on the Site, in particular in the event of non-compliance of the information disseminated by Users, BATEAUX.INFO exercising no a priori control over the content.
The User is informed that the Site may contain hypertext links to other websites or applications. By clicking on these links, the User leaves the Site. As these websites or applications are published and managed by third parties, BATEAUX.INFO has no control over the content published on these websites or applications. BATEAUX.INFO cannot under any circumstances be held liable for any consequences resulting from the fact that the User has followed a hypertext link to a third party site or application, including those of the partners. The User cannot engage the responsibility of BATEAUX.INFO for any delay in the information provided to him or in the event that this information is not up to date. BATEAUX.INFO cannot be held responsible for the consequences, which may be harmful to the User, of the use he makes of the information or Services made available to him through the Site.
BATEAUX.INFO cannot be held liable or retained in the event of temporary or total unavailability of all or part of the access to the Site due to a difficulty related to the response time and, in general, to any lack of performance concerning the operation of the Site.
13 - End of contractual relations
The data relating to a user's account can be destroyed at any time by the user from the parameters of his profile. The User can then no longer access any Site Service. The connection data is archived for 3 months.
INFO BOATS may terminate the contractual relationship with the User. The termination of access to the Services of the Site does not give rise to any compensation or consideration of any kind whatsoever.
14 - Legal scope of the T&Cs
In the event that BATEAUX.INFO does not exercise any of its rights with respect to a User in accordance with the terms of these T&Cs, this act shall not constitute and shall not be interpreted as a definitive waiver by BATEAUX.INFO of the right in question.
Any provision of these T&Cs that is declared void, unenforceable or invalid under any applicable law or court decision that has become final shall be deemed unwritten without invalidating these T&Cs or affecting the validity of the remaining provisions.
In the event of difficulties of interpretation resulting from a contradiction between any of the titles at the top of the clauses and any of the clauses, the titles shall be declared non-existent.
15 - Applicable legislation
Notwithstanding the country in which the User uses the Services, these T&Cs are exclusively governed by French law. Given the global dimension of the Internet network, Users must also comply with the rules applicable to the territory from which they consult the Site or use its Services.
Users are therefore reminded that it is the responsibility of Users to check in advance the legality of the actions they carry out via the Site and its Services with regard to the laws and regulations in force in the territory from which they carry out these actions and operations.
16. Dispute resolution
Bateaux.info and the User must perform their obligations in perfect good faith.
Any disputes or difficulties as well as, more generally, any dispute relating to the interpretation or execution of the present contract shall fall within the exclusive jurisdiction of the Commercial Court of Evry (France).
