Disseminating maritime law to the general public

The legal guide The law of pleasure boating was written to promote knowledge of the rules of maritime law and to foster cohesion between boaters and legal practitioners. Indeed, the law regulating pleasure boating remains largely unknown, and its understanding is too often inaccessible for boaters without legal training. Whether for leisure or as part of a regatta, sailing or motorboat, sea users are unaware of the rules of nautical law. This guide therefore aims to provide simple and accessible answers. It is prefaced by François Gabart, the winner of the Vendée Globe aboard MACIF. Legisplaisance, a maritime law association

This association was born from the idea of Jérôme Heilikman, the founder of the association and current president. It was by writing his end-of-year thesis that he came up with the idea of creating this community During my Master's degree in Maritime Law at the University of Nantes, I became interested in nautical law and decided to write my thesis on the regulation and safety of nautical sports events. It was while talking to my teachers that I had the idea of launching Legisplaisance, a non-profit association." The site has been designed in a simple and accessible way so that everyone can find the answers to their questions The site deals with maritime law and yachting law with the objective of bringing specialists closer to yachtsmen so that they can ask questions and obtain reliable answers. When I created the site, I wanted to do it in a participatory way so that boaters could ask their daily problems and questions about the regulations . A legal guide accessible to the greatest number of people

The law generally refers to complicated and lengthy manuals, which disseminate information that is not necessarily understandable. This guide, written by a group of specialists in maritime law and amateur or professional boaters, seeks to democratize the rules of law and to propose a playful, innovative and unparalleled work to date. Indeed, it consists of 50 teaching sheets, written in a clear and didactic style, illustrated by cartoons. 20 specialists have joined forces to produce a modern guide, providing practical advice and answers to the most common questions.

"In the book, there is a page introducing these twenty writers, all volunteers, who are university professors, lawyers, maritime experts, and even young entrepreneurs." adds Jérôme.

These 50 thematic sheets cover most of the field of yachting activity: from port law to coastal areas, from administrative formalities to taxation, from sailing certificates to the status and safety of ships, as well as the main yachting contracts and liability rules. This legal guide addresses a host of practical issues related to boating and answers each of them in law. The answers are popularized but are based on precise legal references. Here are some examples:

  • Four months after buying a boat, I discover that the hull is eaten away by osmosis. What to do about it? What expertise? Is it a hidden defect or normal wear and tear?
  • What is the insurance coverage for my ship? What about my annex?
  • I am a self-employed yachtsman and I want to take a ship abroad? What will my tax protection be?

"The association was created a year ago, in September 2013. In October 2013, I sent the project to the various parties and at the very beginning of November, all the drafters agreed to produce the guide. It's a project that went relatively quickly since I had the network and then I met the publisher Ancre Marine last year at the Grand Pavois" jérôme explains.

A guide for everyone

The purpose of this guide is to popularize maritime law and, more specifically, pleasure craft law, which is rightly perceived as complex, for the benefit of seafarers, and to create links between specialists in maritime law and pleasure craft. New projects

Finally, Jérôme reveals the association's new projects and the follow-up planned for this legal guide. " Our main project would be to set up round tables at an annual conference so that sailors can meet and discuss boating. We still have to determine the first themes, we have confidence in our network of specialists for future interventions" .
