I am a photographer and owner of a semi-rigid. I would like to organize training outings with clients, but I believe there are regulations to be respected. My insurance is OK, my boat is OK. The Ministry's texts are relatively "hermetic".

Is it necessary to make a declaration to the authorities, Maritime Affairs or Prefecture, in order to be able to make these trips? If I do it through a society, are the rules the same? I don't think I'm the only one in this case. Can you shed some light on this?

A yachtsman who wishes to organise training trips must, in fact, comply with the regulations relating to professional yachting since his activity will be lucrative. That is to say, its vessel must have the status of a NUC (Commercial Use Vessel) with the opening of a business role (the simplest) or a crew role. The competent services are the Delegation for the Sea and the Coast (DML) of the ship's home port.

He must also declare his services and notify his insurer when people board under his responsibility.

As far as social protection is concerned, it remains to be seen how much working time is involved in this activity, because, depending on the case, he will probably be able to remain affiliated to the IHR (in the case of an independent photographer)... or will have to be in a situation of multiple activity with an obligation to be affiliated to the Enim during his on-board services, if the latter are substantial, because he will have the status of professional seafarer (Chief of the ship as an on-board owner) which requires affiliation to the special regime for seafarers.
